The Legal Department has the responsibility to ensure the protection of industrial property rights of Designation of Origin "Vinho Verde" and Geographical Indication "Minho" and to provide legal support to all CVRVV Departments.
In accordance, this department is responsible for the following:
- Management of Industrial Property Rights in the Region (Designations of Origin, Geographical Indications, Trademarks and Logos)
- Validity of existing rights
- maintenance of the validity of national, European and international registration
- regularization of the rights which become eligible for dual protection
- study of the need to extend the protection of existing rights to new countries / rules
- Protection of the CVRVV rights
- opposition to unregistered marks / signs of third parties, by the administrative, judicial and extra judicial means, in the national, Community or international context
- Creation of new rights
- study the need and viability of submitting new applications for registration in the applicable legal context
- Legal Support to the Departments and the Executive Committee
- emission of advice and information
- study and interpretation for the application of new legal national and European rules of the wine sector of legal acts and internal regulations
- analysis and draft of contracts and protocols
- preparation of notarial acts and registration acts
- participation in working groups
- Legal Support to the General Board and the Assemblies of sectors
- administrative and legal assistance to the meetings
- Monitoring national and EU legislation
- daily disclosure to the CVRVV Departments of the relevant legislation by consulting the Portuguese Official Gazette Series I and II of the EU's Official Journal L and C Series
- study of new national or European laws, requested by the Departments and the Executive Committee
- clarification on legislation requested externally
- CVRVV Representation at the International Wine Law Association (AIDV)
- participation in conferences
- information and clarification on national / regional laws and regimes
